1. Acceptance of these Terms

These Terms and Conditions govern your access to and use of Tap10 services that link to these Terms, including our websites, connected mobile applications, business tools, campaigns, reward features, and related communications (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.

In these Terms, "Tap10," "we," "us," and "our" mean Tap10. "You" means the individual or business accessing or using the Services.

2. Who may use Tap10

You may use the Services only if you can legally enter into a binding agreement under the laws that apply to you. If you are under the age required to agree to these Terms in your location, a parent or legal guardian must review and agree to these Terms on your behalf where permitted by law.

If you use the Services on behalf of a company, organization, or other business, you represent that you have authority to bind that entity to these Terms, and "you" includes that entity.

You agree to provide accurate, current, and complete information when you interact with Tap10 and to update your information when needed.

3. Services covered by these Terms

These Terms apply to Tap10 services made available to customers and business partners, including:

  • marketing websites and landing pages that link to these Terms
  • the Tap10 mobile application and connected reward experiences
  • business onboarding flows, partner dashboards, and campaign tools
  • digital coupons, reward challenges, redemption flows, and related communications

Certain features or commercial relationships may also be subject to separate order forms, campaign rules, app store terms, or other supplemental terms. If a supplemental term conflicts with these Terms, the supplemental term will control for that specific feature or transaction.

4. Accounts, access, and security

Some parts of the Services may require you to create an account, access a partner workspace, or otherwise provide credentials. You are responsible for maintaining the confidentiality of your login details and for activities that occur through your account or access method.

You must notify us promptly if you believe your account, credentials, or device access has been compromised or used without authorization.

We may refuse access, require additional verification, or limit access where reasonably necessary to protect the Services, other users, or Tap10 from fraud, abuse, or security risk.

5. Business partner rules

If you use Tap10 as a business partner, merchant, or campaign owner, you are responsible for the campaigns, offers, and redemption terms you create or publish through the Services.

You are responsible for ensuring that your campaign materials, rules, and offer details are lawful, accurate, and clear, including:

  • eligibility requirements and geographic limitations
  • attempt limits, reward limits, dates, and expiration windows
  • inventory availability, minimum purchase rules, and in-store redemption conditions
  • compliance with advertising, consumer protection, tax, and promotion laws that apply to your business

You must honor valid offers that are published through Tap10 unless a campaign is withdrawn, corrected, or suspended in accordance with these Terms or applicable law. We may reject, pause, remove, or restrict a campaign that creates legal, reputational, operational, or security risk.

6. Customer rewards, coupons, and redemption terms

Rewards, digital coupons, and promotional offers available through Tap10 may be subject to merchant-specific conditions, location limits, inventory limits, attempt limits, age restrictions, minimum purchase requirements, timing rules, and other redemption conditions disclosed with the offer.

Tap10 does not guarantee that any specific offer will be available, winnable, redeemable, or unchanged at all times. Unless the offer expressly states otherwise or applicable law requires otherwise, rewards and coupons have no cash value, are not refundable, and are not transferable.

We may cancel, void, or restrict rewards, coupons, or redemptions if we reasonably believe there has been fraud, abuse, automation, manipulation of a challenge, violation of offer rules, or other misuse of the Services.

7. Fees, billing, and payment processing

Some Tap10 services may be offered for a fee. If you purchase paid services from Tap10, the applicable fees, billing terms, and service scope will be disclosed at checkout, in an order form, or in another commercial agreement made available to you.

Payment processing for paid services may be handled by a third-party payment processor. Your use of that processor may also be subject to the processor's own terms and privacy practices.

Unless a separate written agreement says otherwise or applicable law requires otherwise, you are responsible for applicable taxes and fees associated with paid services, and fees paid for services already provided are non-refundable.

8. Acceptable use and prohibited conduct

You agree not to misuse the Services. In particular, you must not:

  • use the Services in violation of applicable law or regulation
  • submit false, misleading, or infringing information or campaign content
  • attempt to bypass offer rules, attempt limits, or security controls
  • use bots, scripts, scraping tools, or other automated means to access or exploit the Services without authorization
  • interfere with the operation, integrity, or performance of the Services
  • attempt unauthorized access to accounts, systems, data, or networks
  • reverse engineer, decompile, or otherwise attempt to extract source code except where applicable law does not allow that restriction
  • upload or transmit malware, harmful code, or abusive content
  • impersonate another person or misrepresent your affiliation with a business or merchant

9. Intellectual property

The Services, including the Tap10 name, branding, software, design, text, graphics, interfaces, and other content made available by Tap10, are owned by Tap10 or its licensors and are protected by intellectual property and other applicable laws.

Subject to these Terms, Tap10 grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for their intended purpose. This right does not include any resale, redistribution, copying, modification, or commercial exploitation of the Services except as expressly permitted by Tap10 or applicable law.

All third-party names, logos, and trademarks appearing through the Services remain the property of their respective owners.

10. Third-party services and links

The Services may integrate with, rely on, or link to third-party services, including app stores, analytics providers, mapping tools, payment processors, merchant systems, or external websites. Those third-party services are governed by their own terms, policies, and operational practices.

Tap10 is not responsible for the availability, content, products, services, or practices of third-party providers or third-party websites. Your interactions with third parties are between you and the relevant third party unless applicable law says otherwise.

11. Service, offer, and platform availability

We work to keep the Services accurate, secure, and available, but we do not guarantee that the Services, any campaign, or any offer will always be available, uninterrupted, timely, secure, or error-free.

Tap10 may update, modify, suspend, limit, or discontinue all or part of the Services at any time. We may also correct pricing, campaign, reward, or content errors, and we may remove content or offers that are inaccurate, unavailable, or no longer supported.

You are responsible for obtaining the internet access, mobile device, browser, and other equipment needed to use the Services, including any data charges or carrier fees that may apply.

12. Disclaimers and limitation of liability

To the extent permitted by law, the Services are provided on an "as is" and "as available" basis. Tap10 does not make guarantees about the continued availability of any campaign, the outcome of any game or reward challenge, or the quality, safety, legality, or suitability of products or services offered by third-party merchants.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Subject to that, Tap10 will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenues, goodwill, data, or business opportunities arising out of or related to the Services.

To the extent permitted by law, Tap10 is also not responsible for losses caused by your misuse of the Services, unsupported devices, connectivity failures, third-party outages, or a merchant's failure to honor its own obligations, except to the extent the loss is caused directly by Tap10's breach of these Terms or other liability that cannot be excluded by law.

13. Suspension and termination

You may stop using the Services at any time. Tap10 may suspend, restrict, or terminate your access to all or part of the Services if we reasonably believe that you have violated these Terms, created legal or security risk, engaged in fraud or abuse, or if we need to do so to protect the Services, our users, or our business.

We may also suspend or remove a campaign, account, reward, or offer if it is unlawful, misleading, technically harmful, commercially unsupported, or no longer available.

Sections that by their nature should survive suspension or termination, including intellectual property, disclaimers, limitation of liability, governing law, and dispute-related provisions, will continue to apply.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the revised version and update the "Last updated" date at the top of the page.

If we make a material change, we may also provide notice through the Services, by email, or by another reasonable method where appropriate.

Your continued use of the Services after the updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.

15. Governing law and dispute handling

These Terms and any non-contractual disputes or claims arising out of or in connection with them are governed by the laws of Bosnia and Herzegovina, without regard to conflict of law principles.

Before starting a formal dispute, you agree to contact us at support@tap10.co and give us a reasonable opportunity to try to resolve the matter informally.

Unless mandatory law gives you rights to bring a claim elsewhere, the courts with jurisdiction in Bosnia and Herzegovina will have authority over disputes arising out of or relating to these Terms. Nothing in this section limits mandatory consumer rights or other rights that applicable law does not allow us to restrict.

16. Privacy policy and contact details

Your use of the Services is also subject to our Privacy Policy, which explains how Tap10 collects, uses, and protects certain information.

If you have questions about these Terms, you may contact us at support@tap10.co or by post at:
